Scope of Application

The terms and conditions contained in this document shall apply to the relationship between the visitor (hereinafter referred to as the ‘Client’) and Calm Suites Apartments from the moment the reservation is requested until the date the accommodation period in the apartments ends.

In matters not covered by the Terms and Conditions, the current Spanish law shall apply.

II. Contractual Agreement

1. By requesting a room reservation, the Client submits a lodging proposal to Calm Suites. If rooms are available, Calm Suites will provide the Client with a reservation code.

2. The Client is informed that room reservations at Calm Suites made by third parties (tour operators or online room reservation portals) involve the issuance of a reservation code different from the one issued directly by Calm Suites, even if it is equally valid.

3. Room reservation requests made directly to Calm Suites or through third parties are not binding and do not obligate Calm Suites to enter into a contract with the Client. Calm Suites always reserves the right to refuse to enter into a contract and provide a room at its sole and discretionary discretion.

4. Calm Suites only guarantees the Client the availability of a room in the reserved category, not the provision of a specific hotel room.

III. Types of reservations and their cancellation

1. At Calm Suites Apartments, the client will be able to make a type of reservation.

2. The reservation can be freely canceled by the client, at no cost, until 4:00 PM on the day of the reservation.

3. The reservation will automatically expire if the client does not check in at the hotel by 4:00 PM on the day of the reservation. In this case, Calm Suites Apartments may immediately allocate the reserved room to any other client without the client who made the reservation being able to claim any compensation from Calm Suites Apartments for any reason whatsoever.

4. If the reservation is canceled in accordance with the preceding paragraph and the client has already made the payment of the amount – as provided in the final part of paragraph 3 of this clause – Calm Suites Apartments will refund the paid amounts.

5. In the event that the cancellation request for the guaranteed reservation is made after 4:00 PM, the client will be charged the room rate for that day, and the reservation will be nullified for the immediately following day. The same principle applies if the client fails to show up on the day of the reservation without canceling the reservation in a timely manner.

IV. Arrival and departure
1. Calm Suites Apartments will provide the client with a room of the reserved category starting from the arrival date, or if the client did not have a prior reservation and arranges accommodation at the hotel reception, based on the intended category and subject to hotel availability, beginning from 2:00 PM and no later than 5:00 PM on the day of check-in.

2. Upon arrival at the hotel, the client must proceed immediately to make payment for the room rate, the number of nights of stay, and any additional services.

3. Upon complete payment of the amount, Calm Suites Apartments will provide the client with an access code to the room, which will be valid during the contracted stay period.

4. On the departure date, the client must vacate the room of occupants and belongings and leave it without any damage by 12:00 PM.

5. In case the room is not vacated by 12:00 PM on the departure day, an immediate compensation equivalent to the cost of one night’s stay at the hotel will be charged, granting only the right to use the room during that period if the hotel has room availability. Otherwise, you will have to pay the compensation and vacate the room as soon as possible.

V. Animals

1. The accommodation of animals is expressly prohibited in Calm Suites Apartments.

2. The introduction of animals by the client into the Apartments will allow Calm Suites to immediately terminate the contract with the client and require them to leave the hotel without refunding the amounts paid for the room during the contracted stay period.

VI. Terms of Use
1. Only the individuals specified in the accommodation reservation will have the right to use the room.

2. Clients must treat the apartment room with care and consideration.

3. The client must treat other hotel guests with consideration and respect the hotel’s rules posted within it, which also form part of the accommodation contract, if applicable.

4. Children under the age of 14 must be supervised by an adult client at all times during their stay at the hotel.

5. It is strongly recommended that the client does not keep or leave any money, jewelry, valuable items, or other valuable belongings in Calm Suites.

6. Calm Suites does not assume any responsibility for the occurrence of theft, loss, or damage to valuable items such as money, jewelry, or other valuable objects, if such events take place in the hotel room or inside vehicles parked in the parking area.

VII. Access to the hotel room by Calm Suites

Calm Suites and its staff have the right to enter the room during the client’s stay in order to perform cleaning, repair, and similar tasks.

VIII. Stay rate and other prices

1. The stay rate to be paid by the client constitutes the consideration for the availability and use of the room during the period from check-in to check-out.

2. The total price of the stay will be charged per night, regardless of whether the client has actually used the room or spent the night there.

3. The applicable rates are the agreed prices or the prices indicated in the current price list of Calm Suites at the time of contract formation. Calm Suites will have the right to increase or decrease the prices if a period of more than four months elapses between the date of reservation by the client and the date of arrival, or if any taxes, visitor contributions, or other charges are changed or introduced.

4. The rates or prices indicated in the terms and accommodation contract are subject to the addition of VAT, unless expressly stated otherwise.

IX. Payment terms

1. The value of the stay and the prices for additional services must be paid in advance, at the time when the client arrives at the hotel, regardless of the billing date.

2. If the duration of the client’s stay is not specified, the price of the stay and the prices for additional services for each night must be paid by 12:00 PM.

3. In the case of stays without a specified departure date, the failure to pay the price of the stay and additional services as per the terms set out in the previous clause results in the immediate termination of the contract. The client is required to vacate the room immediately and return it to Calm Suites without occupants or belongings, and in good condition.

4. The rates for additional services, as per the definition in item #1, will include amounts related to parking, breakfast prices, and other amounts that are not explicitly mentioned in the accommodation contract but are part of the value of the stay.

5. Calm Suites accepts payment in euros, transfers, Maestro, Visa Electron, and credit cards: Visa and MasterCard. Other methods of payment are only allowed in exceptional cases, with the consent sometimes granted by Calm Suites.

X. Claims for material defects

1. The client must inspect the room upon arrival and promptly report any defects they may find.

2. Any defects that appear during the stay must be reported.

3. In the event that a defect is indeed found in the client’s room, Calm Suites has the right to choose between repairing the issue and relocating the client to a room of at least the same category as contracted with the client.

4. For the purposes mentioned above, only serious defects capable of undermining the level of service and quality of Calm Suites are considered. Calm Suites is not obligated to take action in the case of irrelevant or unreasonable complaints, or those related to details that do not conflict with the minimum level of service contracted.

5. In the event that Calm Suites does not have the necessary means to repair the relevant defect or replace the client’s room with one of similar or superior category, the client may only terminate the contract and receive the amount paid for the room. The client cannot demand anything further from Calm Suites for any reason whatsoever.

XI. Responsibility on the part of Calm Suites

1. Calm Suites will only be responsible for damages or losses to the client when such situations result from the culpable actions of Calm Suites.

2. Calm Suites does not assume any responsibility for the loss of data provided by the client in the case of electronic transmission of payment data, being liable only if culpable actions are proven.

3. Calm Suites does not assume any responsibility for damages or accidents that occur within the room or any other part of the hotel, except if such accidents result from the culpable actions of Calm Suites..

4. Calm Suites will not be deemed responsible to the client in case of a delay in room availability, even if there are valid reasons for the lack of timely availability.

5. For the purposes of the preceding clause, valid reasons for the impossibility or more difficult availability of a room include, for example, strikes, blockades, natural disasters, accidents in the room or the hotel.

6. In the event of a delay in room availability beyond 4:00 PM on the day of the reservation, the client is free to terminate the contract without the right to demand any compensation from Calm Suites for any reason whatsoever.

7. Calm Suites does not assume any responsibility for acts carried out by any hotel employee unless they are within their regular working hours, properly identified, and wearing the standard uniform of the company.

8. Calm Suites does not assume any responsibility nor can it in any case be held responsible for the non-fulfillment of accessory obligations.

9. Calm Suites cannot in any case be held liable for any action or omission of any other Client, even if it is likely to cause damage or harm to another Client of the hotel. Any and all damages caused to third parties by hotel guests will be the sole responsibility of these and totally unrelated to Calm Suites.

10. Calm Suites assumes no liability to the Client for any loss of profits or consequential damages even if they result from the breach of the principal obligation.

XII. Duty of notification

In the event of theft or damage to property or, in the event of fire, water damage or other damage to the hotel room, the Customer shall immediately inform the hotel staff and make every effort to assist in resolving the theft or repairing the damage.

XIV. Termination of the housing contract

Calm Suites has the right to terminate the accommodation contract in the event that the Client fails to pay the price in full and on time when due or fails to provide the required security.

2. The Customer may give notice of termination of the accommodation contract during his stay at any time up to 7 p.m., to take effect from 12 noon the following day.

3. Either of the contracting parties may terminate the housing contract summarily for just cause.

4. Calm Suites shall have the right to immediately terminate the accommodation contract for just cause if the Client has any behavior that affects the healthy coexistence, calm or hygiene of the hotel, especially if during his stay at the hotel the Client is under the influence of drugs or alcohol, use the room for prostitution practices, act offensively towards the hotel staff or towards other hotel guests, disturb the peace of the other hotel guests or, in the past, has made malicious false reservations and/or damaged or destroyed the hotel or its facilities.

XV. Data protection

The Client is informed that his personal data will be stored and processed by Calm Suites and made available to Calm Suites’ partner companies and selected service providers, in accordance with the Law, for the purposes of contract execution, for services to the Client and for their own advertising campaigns.

2. The Customer grants Calm Suites the right to use selected partner companies and service providers to perform data processing and the right to transmit such personal data under this section to companies that allow them to store and process it.

3. The Client has the right to object at any time to the use of personal data for advertising purposes, having to demonstrate this intention in writing to Calm Suites.

4. Unless there is legislation to the contrary, the Client’s personal data must be discarded when the hosting contract terminates and the legal retention periods have expired.

5. Full details of the data protection policy can be obtained from Calm Suites.

XVI. General Provisions

1. The terms and conditions govern in their entirety the Customer’s stay at the hotel and its use of the room.

No verbal agreement is reached in the housing contract and all alterations to the contract between the parties must necessarily be in writing and signed by both parties, except in the case of a unilateral declaration, in which case it must be stated in the written document signed by the issuer.

3. Calm Suites shall have the right to have third parties perform its obligations under and within the scope of the accommodation contract.

4. The invalidity of one or more of the foregoing provisions shall not prejudice the validity of the other provisions. The invalid provision shall be replaced by the valid provision, the closest of the commercial and legal intentions of the parties or, if not possible, by the Portuguese legislation in force.

XVII. Special conditions for trade fair and special event dates

Calm Suites must inform the Client as to the dates of fairs and special events at any time of the request and in any case, at the latest on the date of the reservation or arrival. The following information applies to the dates of trade shows and special events, notwithstanding, or in addition to, the above provisions:

Guaranteed reservations will only be accepted for extended stays. Reservations for one night only will not be allowed.
